Angelina County, Texas Court Records

When a case is filed with the clerk of any courthouse, a corresponding court record is created and updated throughout the case cycle. Angelina County court records encompass all documents submitted to or created by the court clerk during this process, from filing up to when the court passes its final judgment on a matter. The creation, maintenance, and public dissemination of court records are responsibilities of the clerk of the specific court that handled a matter, although multiple agencies, up to the state and federal levels, typically maintain databases that include these records.

Furthermore, court records do not exist independently. Other public agencies like the Texas Department of State Health Services (DSHS) and the Angelina County Sheriff's Office maintain records that are connected to court records, such as vital records (marriage records, death records, divorce records, and birth records), and arrest records. For instance, criminal records are often connected to an arrest that was made by the sheriff's office, for which a corresponding arrest record was created.

Are Angelina County Court Records Public?

Yes. Angelina County court records are public under the Texas Public Information Act (TPIA) provided the record of interest is not confidential by law and/or otherwise protected for legitimate reasons. In line with this law, the general public has the right to promptly view and obtain copies of public court records. When a court record is withheld from public access, it is often because there is a court order sealing the record, provisions under law prohibit their disclosure, or it contains sensitive information. Common examples of non-public court records include:

  • Juvenile identification information
  • Information that could aid identity theft, such as social security numbers, complete credit card numbers, driver's license numbers, etc.
  • Information about ongoing investigations
  • Information protected by client-attorney privilege
  • Expunged records
  • Medical reports/mental health evaluation records

Criminal Records Access in Angelina County

Criminal case records are public and are available through the district's or county clerk's office. Record seekers may submit their record request in person, by mail, email, or in person, and the request must be accompanied by the appropriate fee. Criminal court records are also available through the Angelina County Judicial Search website. Regardless of the method, a criminal record search requires the defendant's name, the attorney's name, or the case number.

The Texas Department of Public Safety (TXDPS) handles all criminal background checks. Note that criminal background checks differ from criminal court case searches and are used to check if there are any criminal convictions attached to an individual's name. The Crime Records Division of the DPS handles these inquiries and provides an online name-based criminal history search portal. To search for records via this website, a person must first create an account on the website, then proceed to purchase credits at $1.00 each. Searches require a person's full name.

Angelina County Probate Records

Angelina probate records include official documents created in relation to the administration of a person's estate, including their will and assets. They are accessible online via the county's court case search portal or in person at the court clerk's office. Although Texas law treats probate records as public, they often contain sensitive information, which is typically redacted or sealed, such as when it relates to a minor or includes bank account details.

Common probate cases are guardianships, conservatorships, estate administration, and probate of wills. Probate matters filed in Angelina County fall within the jurisdiction of the Angelina County Courts at Law, Probate Division.

Angelina County Family Court Records

The Angelina County Courts at Law share concurrent jurisdiction with the county's District Courts over domestic relations cases. Family cases heard in these courts include divorces, paternity, child custody, child support, annulments, and adoptions. Family case records are public under Texas' public information act, although exemptions allow court clerks to restrict access to records containing juvenile information, financial records, medical records, and similar documents deemed confidential by law.

Other records are available for public inspection online and through the court clerk's office. Record requests follow the same general procedure and require a case party's name or the case number, and the appropriate fee. It is also important to identify the specific court where a case was filed before filing a request. Note that certified copies are only available to case parties. To access non-public family case records, a person must be a case party, their attorney, a legal representative, or a close family member. Otherwise, they must demonstrate legitimate interest and must obtain a court order granting them access.
